Terms and Conditions

 

  1.  General Provisions

    1. These Terms and Conditions govern the use of the online platform located at www.wanderlhasa.com (hereinafter referred to as the "Service"). By registering on or otherwise using the Service, you (the "Client") agree to these Terms and Conditions, as well as the accompanying Privacy Policy, which forms an integral part of these Terms and Conditions. The services provided through the Service offered by Alicja Białogłowska, trading as Wander-lhasa, with a registered office at Siennów 44, 37-205 Zarzecze, Poland, registered under REGON number: 386857260 and NIP number: 6292497653 (hereinafter referred to as "Wander-lhasa"). Wander-lhasa is the owner and operator of the Service.

    2. By using the Website, you agree to comply with these Terms and Conditions.

    3. You acknowledge and agree that Wander-lhasa is not the provider of the attractions and services listed in the travel proposal, but merely presents a compilation of third-party offers.

    4. Wander-lhasa provides services electronically via the Website. Free services include: the Form, Newsletter, free Consultations. Paid services include: the Travel Plan, Gift Card, paid Consultations, remote travel assistance, and facilitation of contracts between you and third-party service providers.

  2. Use of the Service

    1. You agree to use the Website in a manner consistent with applicable law, good practices, and the provisions of these Terms and Conditions.

    2. You are prohibited from engaging in any activity that could interfere with the proper functioning of the Website, including the posting of unlawful or offensive content.

    3. Wander-lhasa reserves the right to modify or remove content posted on the Website and to temporarily suspend its operation for maintenance or technical reasons.

    4. To use all functionalities of the Website, the following minimum technical requirements must be met: Internet access and ent web browser.

    5. The Form and other rights granted by Wander-lhasa are subject to the following restrictions: you may not reproduce, distribute, rent, sell, or otherwise redistribute any elements of the Form or the Website without the prior written consent of Wander-lhasa, whether for consideration or free of charge; you may not modify, compile, or create derivative works based on Wander-lhasa’s intellectual property; and you may not use Wander-lhasa’s intellectual property for unlawful purposes or to the detriment of Wander-lhasa. Even when using the services or Website under permitted use, you must not remove copyright notices or any other designations, including those on copies.

    6. Any agreement for the provision of free services may be terminated by either party at any time without providing a reason, in accordance with the procedures outlined herein or elsewhere in these Terms and Conditions. Agreements for electronic services involving the use of forms are entered into for a fixed term and terminate upon the submission of the form to Wander-lhasa or the cessation of form use. You may also opt-out of interactive form services by discontinuing use of such services.

  3.  Travel Plan

    1. Travel Plan Request: To receive a Travel Plan, the Client must submit a completed Form to Wander-lhasa. The Client may also send an email detailing the request.

    2. Confirmation of Order: Wander-lhasa will confirm receipt of the request by sending an email to the address provided in the Form within 48 hours of submission. This email will include the price, a payment link, and the estimated completion time for the Travel Plan, calculated from the date payment is received.

    3. Acceptance and Payment: The Client must respond to the confirmation email, indicating acceptance of the order and completing the payment specified in the email. Payment confirms the agreement and acceptance of these Terms and Conditions.

    4. Online Payment: The Client may also pay for the Travel Plan online via the Website.

    5. Order Cancellation: If the Client fails to respond to the confirmation email or fails to make the payment, it will be considered a cancellation of the service.

    6. Delivery of Travel Plan: Wander-lhasa will deliver the travel proposal within the time specified in the confirmation email, calculated from the date the payment is received. To expedite the process, the Client may send a bank transfer confirmation.

    7. Payment first: Wander-lhasa does not begin work on the order until the deposit is paid.

    8. Right to Delay or Refuse Service: Wander-lhasa reserves the right to delay or refuse service for requests that are submitted too close to the travel date, contain insufficient or incorrect information, are made with the intent of disrupting Wander-lhasa's operations, or in other justified cases.

    9. Acceptance of Travel Plan: Upon receiving the completed Travel Plan, the Client must either accept the proposal or request modifications within the time specified in the accompanying email. If no contact is made within 7 days of delivery, the Travel Plan will be considered accepted.

    10. Modification of Travel Plan: Changes to the Travel Plan may be requested via email, WhatsApp chat, phone call, or a scheduled online consultation through Zoom. Wander-lhasa will implement changes until the Client is fully satisfied, without incurring additional costs.

    11. Additional Costs: Wander-lhasa reserves the right to charge additional fees if the original request is significantly altered, such as extending the travel duration, adding new attractions, or changing the travel destination or preferred activities.

    12. Revised Travel Proposal: If the Client requests a revised travel proposal, the above procedure will apply accordingly.

    13. Validity of Proposal: The travel proposal provided by Wander-lhasa reflects the current state of available services and attractions at the time of its preparation. Since these elements are beyond Wander-lhasa's control, they may change without liability on Wander-lhasa's part.

    14. Additional Services: The Client may choose to purchase additional services marked as "Extra" in the Service after the Travel Plan has been accepted. Such purchases will require a new agreement on the price and completion time, following the procedure outlined above.

    15. Supplemental Services: If the Client wishes to expand the Travel Plan to include additional "Extra" services after the initial order has been accepted, payment for these services must be made within 48 hours of receiving the price confirmation from Wander-lhasa. The original completion time may be extended depending on the complexity of the additional services.

    16. Refund Policy: If Wander-lhasa fails to deliver a Travel Plan that satisfies the Client, any payments made for an unaccepted travel proposal will be promptly refunded.

    17. Payment term:If the Extra Service “Remote care while traveling” is selected, the customer pays the cost of the service in accordance with the amount and date stated on the invoice.

    18. Right to Refund: If Wander-lhasa delivers a Travel Plan that meets the specifications outlined in the Form and any additional agreements (e.g., through text messages or online consultations), but the Client deems the Plan unsatisfactory, the Client may request a full refund. This request must be supported by evidence that the Travel Plan does not meet the agreed-upon specifications. If Wander-lhasa verifies that the Plan does not meet the agreed-upon criteria, a refund will be issued promptly.

    19. Failure to Agrument the Refund: If, on the other hand, the Travel Plan has been drawn up in accordance with the specifications in the Form and in compliance with any further specifications and guidelines, and the Customer finds the Plan unsatisfactory, being unable to point to arguments proving Wander-lhasa's failure to fulfill the contract, the costs will not be refunded.

    20. No Refunds for "Extra" Services: Wander-lhasa will not refund costs for "Extra" services purchased from third-party providers.

    21. Urgent orders: For orders marked as urgent (when the Client's trip starts in a week or less), additional costs may be charged.

  4. Power of Attorney

    1.  Grant of Authority: By entering into an Agreement with Wander-lhasa, the Client grants Wander-lhasa the authority to:

      1. Enter into contracts with third-party service providers and attraction providers specified in the Travel Plan on behalf of and for the benefit of the Client;

      2. Perform factual and legal actions necessary to execute the services and attractions included in the travel proposal;

      3. Transfer the Client's funds to third-party service providers for the purpose of fulfilling those services and attractions;

      4. Pursue claims related to the non-performance or improper performance of contracts by third-party service providers, subject to special conditions agreed upon between Wander-lhasa and the Client.

    2. Scope of Authority: The power of attorney is limited to the amount specified in the travel proposal that forms the subject of the Agreement. It does not authorize Wander-lhasa to incur any debt or other negative financial obligations on behalf of the Client that are not included in the travel proposal. If the cost of services changes slightly, Wander-lhasa is authorized to incur obligations on behalf of the Client up to 10% above the agreed amount without prior consultation.

  5.  Insurance

    1. Information on Insurance: Wander-lhasa may include information about various insurance options available in the market that are appropriate for the risks associated with the attractions and services outlined in your travel proposal. However, these are provided solely for informational purposes, and the decision to purchase or not purchase insurance is entirely at the discretion of the Client. This decision does not impact the execution of the travel proposal.

    2. No Insurance Provision: Wander-lhasa is not a provider of travel insurance and does not offer any insurance related to the travel described in your proposal. The responsibility to obtain adequate travel insurance lies solely with the Client.

  6. Payments

    1. Service Fees: The fee for the creation of the Travel Plan and for acting on your behalf in arranging contracts with service providers listed in the Travel Plan is payable to Wander-lhasa. This fee is for the service rendered and not for the provision of the attractions or services specified in the Travel Plan.

    2. Fee for Travel Plan: The fee for the preparation of the Travel Plan depends on the length of the trip and the information on the amount can be found on the website of the service. This is the amount for making the Travel Plan in the standard formula (without purchasing Extra Services from third parties or Remote Care during the trip).

    3. Client’s Role in Contracts: You are the party to the agreements entered into with the third-party service providers as a result of the Travel Plan. Therefore, you are responsible for all payments to these service providers and for handling any issues arising from the use of their services. Wander-lhasa will provide you with all necessary contact information to facilitate this.

    4. Payment Methods: Payments can be made through the following methods: a third-party online payment system “Stripe” or by a bank account transffer, through Paypal or via BLIK. You are responsible for ensuring that your payment method is valid and that sufficient funds or credit are available to complete the payment.

    5. Late Payments: Wander-lhasa reserves the right to suspend or terminate the Service if you fail to make timely payments. In the event of late payments, Wander-lhasa may charge interest at the maximum rate permitted by law.

    6. Remote Care Pricing: The cost for remote care services provided during your trip will be specified in the Travel Plan and is subject to the terms agreed upon at the time of purchase. These fees are separate from the cost of the Travel Plan and are payable in advance or as otherwise agreed.

    7. Service Provision Fee: Wander-lhasa charges a service provision fee of 5% for acting on your behalf in arranging services and attractions listed in the Travel Plan. This fee is included in the total cost provided to you and is non-refundable once the service is rendered.

    8. The VAT invoice for Extra services provided by Wander-lhasa (i.e., restaurant table reservations and remote care during the trip) is set individually, according to the price list below.

      1. Pricing for booking tables in restaurants: 

        1. in Poland: up to 3 bookings: PLN 30, up to 10 bookings: 80 zł

        2. within the European Union: up to 3 bookings PLN 50, up to 10 bookings PLN 140

        3. outside the European Union: up to 3 bookings PLN 60, up to 10 bookings PLN 200

      2. Pricing for remote care during travel:The payment amount for remote care during the travel is always determined individually, according to the price list in the Table no. 1 which is an integral part of this document.

    9. Wander-lhasa is not responsible for the accuracy of invoices and bills issued by third-party service providers.

    10. Wander-lhasa does not act for the providers of the attractions and services indicated in the trip proposal. Wander-lhasa will provide the Customer with the necessary data to enable contact between the Customer and the service provider.

  7.  Compaints

    1. Right to Submit Complaints: The Client has the right to submit complaints regarding the functioning of the Service or the quality of the Services provided by Wander-lhasa. Complaints should contain sufficient details to identify the Client and describe the nature of the complaint, including any reasonable objections and comments regarding the Service or Services.

    2. Submission of Complaints: Complaints should be submitted via email to info@wanderlhasa.com or by post to the correspondence address of Wander-lhasa. If the complaint requires further clarification, Wander-lhasa will contact the Client to request additional information.

    3. Response to Complaints: Wander-lhasa will respond to complaints within 14 days from the date of receipt. The response will be sent to the email address from which the complaint was received or to the address provided by the Client in the complaint submission.

    4. Third-Party Service Complaints: Complaints regarding the non-performance or improper performance of agreements made between the Client and third-party service providers must be directed to those providers. As Wander-lhasa is not a party to these agreements, it bears no responsibility for their execution or any associated issues.

  8.  NEWSLETTER

    1. The Newsletter subscription service is provided free of charge by Wander-lhasa to customers who voluntarily agree to it.

    2.  The customer may terminate the Newsletter service agreement at any time with immediate effect by deactivating the subscription, through the corresponding deactivation link, located in the footer of each message sent within the Newsletter.

  9. GIFT CARD

    1. A Gift Card, referred to as a Travel Gift Card in the Service, can be ordered through the Service.

    2. The Gift Card can be purchased for yourself or for the recipient of your choice.

    3. The Gift Card for the recipient is sent automatically from the system after payment for the selected option to the e-mail address of the recipient provided in the Gift Card form.

    4. A Gift Card for yourself is sent to the customer's email address after paying for the selected option.

    5. The Gift Card can be purchased in the option of your choice:

      1. in the amount of 400 zł - weekend Travel Plan (up to 4 days)

      2. in the amount of 800 zł - one week Travel Plan (up to 10 days)

      3. in the amount of 1200 zł - 2-3 tweek Travel Plan (up to 21 days)

    6. The purchase of the Gift Card is non-refundable.

    7. The Gift Card is valid for 12 months from the date of purchase.

  10. HOME OFFICE

    1. The “Home Office” service involves finding accommodation for the client to work remotely.

    2. Necessary condition is to submit a form available on the website.

    3. The minimum rental time is one week.

    4. The price of the service depends strictly on the provider's offer and I send the client his offer without any surcharges. After accepting the offer, I add a commission of 15% of the offer price on the issued VAT invoice.

    5. In case of longer cooperation, the amount of commission may be reduced.

  11. CONSULTATIONS

    1. The Consultation Service is designed to help you travel or prepare for travel.

    2. This service can be free or paid.

      1. A free consultation is available at the first consultation or after you have purchased the Travel Plan and need to discuss it or make changes. It lasts 15 minutes.

      2. The paid consultation is designed to support and answer questions 

  12.  LIABILITY

    1. Exclusion of Liability for Third-Party Services: Wander-lhasa shall not be held liable for the non-performance or improper performance of services provided by third-party entities as listed in the travel proposal. The Client is responsible for addressing any issues directly with the relevant service providers.

    2. Responsibility for Legal Formalities: The Client is responsible for fulfilling all formal legal requirements, such as passport or visa requirements, necessary for the travel described in the proposal. Wander-lhasa is not liable for any errors or omissions on the part of the Client in relation to these formalities, nor for any resulting denial of a passport or visa.

    3. Insurance Responsibility: Wander-lhasa is not responsible for the Client's decision to obtain or not obtain travel insurance or any other insurance related to the trip described in the proposal. Any consequences resulting from the lack of adequate insurance are the sole responsibility of the Client.

  13.  Amendments to the Terms and Conditions

    1. Right to Amend: Wander-lhasa reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Client via the Website or by email.

    2. Acceptance of Amendments: Continued use of the Service after the effective date of the amendments will be deemed acceptance of the updated Terms and Conditions. If the Client does not agree with the amendments, they must discontinue the use of the Service.

  14. Personal Data Protecion

    1. The Administrator shall process users' personal data in accordance with applicable laws, including GDPR.

    2. For detailed information on data protection, please refer to the Privacy Policy.

  15. Final Provisions

    1. Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of Poland.

    2. Jurisdiction: Any disputes arising out of or in connection with these Terms and Conditions or the use of the Service shall be subject to the exclusive jurisdiction of the Polish courts.

    3. Entire Agreement: These Terms and Conditions, along with the Privacy Policy and any other documents referenced herein, constitute the entire agreement between the Client and Wander-lhasa regarding the use of the Service and supersede any prior agreements, understandings, or representations.

    4. Severability: If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

    5. Waiver: The failure of Wander-lhasa to enforce any provision of these Terms and Conditions shall not be construed as a waiver of its rights under these Terms and Conditions, and such waiver shall only be effective if in writing and signed by an authorized representative of Wander-lhasa.

    6. Force Majeure: Wander-lhasa shall not be liable for any delay or failure to perform its obligations under these Terms and Conditions due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes, or other labor disputes, government restrictions, or disruptions in internet or telecommunications services.
